Welcome to Pickle Protocol. The terms "we," "us," and "our" refer to Pickle Protocol. If we decline, modify, or cancel an order, we will attempt to notify you via the email address, billing address, or phone number provided at the time of purchase.

You represent and warrant that your purchases are for personal or household use only, and not for commercial resale or export.

Section 4 – Prices and Billing

Prices, discounts, and promotions are subject to change without notice. The price charged for a product will be the price in effect at the time your order is placed, as reflected in your order confirmation email. Unless otherwise stated, posted prices do not include taxes, shipping, handling, or customs and import charges.

We are not responsible for delays caused by carriers, customs processing, or circumstances outside our control. Once a product is transferred to the carrier, title and risk of loss passes to you.

Pickle Protocol is powered by Shopify. However, all sales and purchases made in our store are made directly with Pickle Protocol. You expressly release Shopify and its affiliates from all claims arising from your transactions with Pickle Protocol.

EXCEPT AS EXPRESSLY STATED BY PICKLE PROTOCOL, THE SERVICES AND ALL PRODUCTS OFFERED THROUGH THEM ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OR CONDITIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT YOUR USE OF THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO THE ABOVE MAY NOT FULLY APPLY TO YOU.

TO THE FULLEST EXTENT PERMITTED BY LAW, PICKLE PROTOCOL, ITS PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, AND LICENSORS — AND THOSE OF SHOPIFY AND ITS AFFILIATES — SHALL NOT BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA, OR REPLACEMENT COSTS, ARISING FROM YOUR USE OF THE SERVICES OR ANY PRODUCTS PURCHASED THROUGH THEM, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Section 17 – Indemnification

You agree to indemnify, defend, and hold harmless Pickle Protocol, Shopify, and our respective affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from any losses, damages, liabilities, or claims — including reasonable attorneys' fees — arising out of: (1) your breach of these Terms; (2) your violation of any law or third-party rights; or (3) your access to and use of the Services.

We will notify you of any indemnifiable claim. We may control the defense and settlement of such claims at your expense, but will not settle any claim requiring non-monetary obligations from you without your consent (not to be unreasonably withheld).

Section 18 – Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the unenforceable portion will be severed from these Terms. The remaining provisions will remain in full force and effect.

Section 19 – Waiver; Entire Agreement

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

These Terms, together with any policies or operating rules posted on our Services, constitute the entire agreement between you and Pickle Protocol regarding your use of the Services, superseding any prior agreements or communications.

Any ambiguities in interpreting these Terms shall not be construed against the drafting party.

Section 20 – Assignment

You may not transfer or assign this agreement or any of your rights or obligations under these Terms without our prior written consent. Any such attempt will be null and void. We may transfer or assign these Terms and our rights and obligations without consent or notice to you.

Section 21 – Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California. You and Pickle Protocol consent to exclusive venue and personal jurisdiction in the federal and state courts located in California.

Section headings are included for convenience only and do not limit or affect the interpretation of these Terms.

We reserve the right to update or modify these Terms at any time by posting the revised version on this page. It is your responsibility to review these Terms periodically.
